Chevrons Dance

CLASS PARTICIPATION IS BASED ON AGREEMENT TO THE FOLLOWING TERMS AND CONDITIONS:

  1. All items produced by Chevrons Dance (including original music edits, choreography, creative concepts, costumes, props and sets) remain the property of Chevrons Dance and cannot be replicated or reproduced. All dance teaching staff are appropriately qualified and skilled in the delivery of dance tuition and while Chevrons Dance will not be held responsible for any injuries which may occur whilst in class at various facilities or on the premises at 8 Rennie St., Chevrons Dance will seek medical attention or administer basic first aid for you or your child immediately if needed.

  2. In order to provide adequate dance training, it is necessary for dance teachers to physically coach in the development of student technique and placement, which may require strictly appropriate physical contact between dance teaching staff and students. It is also understood that any sort of development cannot occur without a formal and structured approach to all dance classes administered at Chevrons Dance. Dance is a form of discipline and this will be advocated throughout all dance classes at Chevrons Dance.

  3. It is understood that non-refundable Class fee applies to all students at the commencement of their class. The fee is determined based on class type being undertaken.

  4. Payment for all pre-booked lessons missed will be expected where there is an event size limit due to facility capacity. A courtesy email, phone call or text message is expected for all pre-booked events that you are unable to attend.

  5. It is understood that there are NO REFUNDS on any payment of fees, course fee, costume hire and video order unless unforeseeable circumstances means that classes must cease for the Term at the direction of the Director or drastic personal circumstances have occurred. At any case, plenty of communication must occur between student, parent and teachers in these sorts of circumstances.

  6. It is understood that those students participating in classes of a ‘Competitor Training Class’ nature are expected to represent Chevrons Dance in competitions and performances throughout the dancing year. These may involve further costs such as; rehearsals, costume hire fees and entry fees.

  7. By participating in the ‘Competitor Training Class’ all regular students in this class are giving consent for Chevrons Dance to use photographs and/or video footage of the dance student for promotional purposes e.g. website, newspapers, events or flyers.

  8. Please be aware that Chevrons Dance reserve the right to sell videos of students who participate in the Competitor Training Class and professional performance and/or group photos. Original photographs/videos taken by staff are held securely by Chevrons Dance and used for business purposes only.

  9. All students / parents are responsible for remaining up to date with studio information. Many avenues are provided to do this; Group representative emails, Facebook updates and a detailed website.

  10. Chevrons Dance cannot be held responsible for any property lost or damaged on the premises.

  11. All students & parents must behave in a respectable manner towards all staff members of Chevrons Dance both inside the studio / class & out.  Any kind of rude, disrespectful or disruptive behaviour will result in the immediate expulsion of the student from the class, forfeiting any fee, term or advance payment.

  12. All students & parents must respect all decisions made by the Director of the studio.

  13. During the period of enrollment and participation at Chevrons Dance, it is the responsibility of the parent or guardian to advise the Director if personal circumstances and/or information change

  14. All students must be over the age of 18. Any student under 18 years of age understands that A Parent or Guardian must have paid for class entry as well and must be present at all times.

  15. Provision of a safe and effective dance (exercise) is dependent upon accurate health and fitness profiling. It is your responsibility to seek medical clearance prior to commencing any dance (exercise) program if you are in any doubt about your fitness level for the class being undertaken. You agree to disclose to us all relevant personal health and fitness information both prior to and during engagement in any dance (exercise) program, service or facility we provide to you, as part of your class. This is inclusive of any health risk assessment, initial and periodic fitness assessment and relevant information or recommendations provided by your medical practitioner. You further warrant and represent that you will not use Chevrons Dance or any of the facilities or services or whilst you are suffering from any infections or contagious illness, disease or other ailment or whilst you are suffering from any physical ailment such as open cuts, or sores, or minor infections where there is a risk, however small, to other students and staff. We reserve the right to refuse entry based on health reasons for the safety of our students.

  16. Dress Code – Fully enclosed, well fitting, clean dance shoes or similar must be worn on dance floor areas for safety reasons. Appropriate comfortable clothes that allow an extendible range of movement should be worn at all times.
  17. Towels and Personal Hygiene Towels must be used when required while participating in classes. This is to maintain hygiene and safety standards.

  18. Chevrons Dance may cancel or reschedule any class where student numbers have not reached Facility break even costs. 48 hours prior notice will be provided to all students booked to attend. Full refunds of fees paid and applicable to cancelled class shall be made. Optional rescheduling to similar class may also be offered.
  19. Right of Entry: Chevrons Dance, it’s directors and staff may refuse entry to individuals and groups where it is considered detrimental to it’s ongoing business. It is an explicit condition of entry that full and frank disclosure of all persons running or organising dance instruction of any style elsewhere be brought to the attention of the directors of Chevrons Dance prior to their arrival at the facility.
  20. You are aware that your use of the premises and its facilities and your participation in the classes and programs conducted by Chevrons Dance may involve strenuous activity and risk (special or otherwise) associated with participation. You release Chevrons Dance and its directors, employees, contractors and agents (the ‘staff’) from all liability and responsibility whatsoever. This includes personal injury, property damage, or death however caused, but not limited to the negligence (whether passive or active) of Chevrons Dance or its’ staff or any other person using the premises. Please refer to the Civil Liability Act 2002 for more information. (www.legislation.nsw.gov.au).Warning under the Australian Consumer Law and Fair Trading Act 2012 (Victorian memberships only)Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form (Parties named in Section 1) is required to ensure that the recreational services it supplies to you:are rendered with due care and skill; and

    are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and

    might reasonably be expected to achieve any result you have made known to the supplier.

    Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you.

    By acknowledging this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services
